Terms of Service

These Terms of Service (“Terms”) govern your use of this website and your participation in programs, classes, and services offered by M.A.M.A. Community Foundation, Inc. (“MCF,” “we,” “our,” or “us”), a nonprofit organization dedicated to improving maternal and family health through education, support, and community-based resources.

By accessing the Site or participating in any of our programs or Services, you agree to these Terms, our Website Terms of Use, and our Privacy Policy. If you do not agree, please discontinue use of the Site and Services.


1. Nature of the Services (Non-Medical)

MCF provides non-clinical, educational, and supportive services, which may include:

  • Childbirth education (virtual or in-person)

  • Doula support (prenatal, labor, and postpartum)

  • Lactation counseling and peer education (non-medical)

  • Workshops, classes, and support groups

  • Referrals and community resource navigation

  • Community-driven programs through the Community Doula Network

These Services are not medical care, are not a substitute for medical treatment or diagnosis, and do not create a medical provider–patient relationship.

You agree to:

  • Consult your healthcare provider for medical questions

  • Seek emergency care when needed

  • Understand that all information provided is educational in nature

MCF does not provide emergency care. In an emergency, call 911 immediately.


2. Third-Party Websites, Platforms & Content

The Site may link to or integrate third-party applications, event platforms, learning tools, payment processors, or resource websites. These are not controlled by MCF.

You understand and agree that:

  • Third-party sites and tools have their own terms and privacy practices

  • MCF is not responsible for their content, accuracy, availability, or security

  • MCF does not endorse third-party products or information

  • Use of third-party platforms is at your own risk


3. Payment and Fees

Some Services (such as classes, workshops, trainings, or certain doula programs) may require payment.

By enrolling in fee-based Services, you agree that:

  • All fees are in U.S. dollars

  • You are responsible for paying applicable fees at the time of enrollment

  • MCF may use third-party processors to collect payments

  • Prices may change for future offerings

If a program has a cancellation or missed-session policy, you agree to follow the terms outlined for that program.

Donations

Charitable donations are voluntary and generally non-refundable unless required by law.


4. Medicaid & Insurance Benefits Authorization and Assignment

For certain programs, including doula support offered through the Community Doula Network or other funded initiatives, MCF may seek reimbursement from Medicaid, Medicaid Managed Care Organizations (“MCOs”), or private insurance plans.

By enrolling in a program for which Medicaid or insurance reimbursement may apply, you agree to the following:

1. Authorization to Release Information
You authorize MCF to release any information necessary to process claims or secure payment from Medicaid, an MCO, or a private insurance plan, in compliance with applicable laws.

2. Assignment of Benefits
You assign to MCF the right to receive direct payment of any Medicaid or insurance benefits available for doula or related supportive services.

3. No Impact on Free Services
If you are participating in a free program, you will not be billed for any balance if Medicaid or insurance denies payment.
Your eligibility for free services is not affected by MCF’s ability or attempt to bill Medicaid or insurance.

4. Reduced-Fee or Sliding Scale Programs
If you enroll in a low-cost program, you agree to pay the portion designated as your responsibility.

5. Non-Covered Services
If you enroll in a fee-based program, you understand some services may not be covered by insurance. You are responsible for any uncovered portion unless otherwise stated.

6. Cooperation
You agree to provide accurate insurance information and notify MCF of coverage changes.


5. Communications

By using the Site or enrolling in Services, you agree that MCF may contact you:

  • By email

  • By phone or text when applicable

  • Through the Site

  • With program reminders, updates, or relevant information

You may opt out of non-essential communications. Opting out does not remove your responsibility to review updates posted on the Site.

MCF email and messaging are not instant-response and should not be used for urgent matters.


6. Privacy & Security

MCF handles your personal information according to our Privacy Policy.

MCF may collect information needed to:

  • Register participants

  • Communicate with users

  • Provide programming

  • Seek reimbursement when applicable

While we take reasonable measures to protect your information, no electronic system is entirely secure.


7. User Accounts (If Applicable)

Some Services require an account or registration. You agree to:

  • Provide accurate, updated information

  • Maintain the confidentiality of your login credentials

  • Notify MCF of unauthorized access

You may register minors only if you are the parent or legal guardian.


8. Acceptable Use & Access Rights

MCF grants you a limited, non-transferable right to use the Site and Services for personal, non-commercial purposes.

You agree NOT to:

  • Misuse or disrupt the Site

  • Impersonate others

  • Harass staff, doulas, or participants

  • Attempt to reverse-engineer or breach system security

  • Use MCF materials for commercial purposes without permission

MCF may suspend or terminate access for violations of these Terms.


9. Termination

You may discontinue use at any time.
MCF may suspend or terminate your access or account for any reason, including:

  • Policy violations

  • Inappropriate behavior

  • Misuse of Services

MCF retains records in accordance with nonprofit and legal requirements.


10. Modifications to Terms

MCF may update these Terms at any time. Changes will be posted on the Site and, where appropriate, communicated to users.

Continued use of the Site or Services constitutes acceptance of updated Terms.


11. Disclaimer of Warranties

YOU AGREE THAT USE OF THE SITE AND SERVICES IS AT YOUR OWN RISK.
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

MCF DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OR COMPLETENESS OF CONTENT

MCF does not guarantee:

  • Error-free operation

  • Uninterrupted access

  • That content is complete, current, or accurate

All MCF offerings are educational and supportive only, not medical advice.


12. Geographic Restrictions

The Site and Services are intended for U.S.-based users.
Users outside the U.S. are responsible for complying with local laws.


13. Dispute Resolution

Management Resolution:
Parties must first attempt to resolve disputes through direct discussion.

Arbitration:
If unresolved, disputes will be settled through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You waive the right to a jury trial and agree to resolve disputes individually (no class actions), to the extent permitted by law.


14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCF WILL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • LOSS OF DATA, REVENUE, OR PROFITS

  • SERVICE INTERRUPTIONS

  • ANY DAMAGES ARISING FROM USE OR INABILITY TO USE THE SITE OR SERVICES

MCF’s total liability shall not exceed $100 or the amount you paid to MCF in the past six months (if any).


15. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MCF, ITS OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND AFFILIATES FROM ANY CLAIMS ARISING OUT OF:

  • YOUR USE OF THE SITE OR SERVICES

  • YOUR VIOLATION OF THESE TERMS

  • YOUR VIOLATION OF ANY RIGHTS OF OTHERS


16. Governing Law & Injunctive Relief

These Terms are governed by the laws of the District of Columbia.

Legal proceedings to compel arbitration or seek injunctive relief may be brought only in the District of Columbia.


17. Agreement to Service

By using the Site or participating in the Services, you acknowledge and agree that:

  • You have read these Terms

  • Your participation constitutes acceptance

  • Your electronic acceptance is legally binding
